Golden Floating Dock Warranty
GOLDEN FLOATING DOCK LIMITED WARRANTY
1. THIS WARRANTY COVERS THE FOLLOWING:
A. Floating Docks and gangways purchased after November 01, 2016 from Golden Marine Systems, LLC (the “Company”), are warrantied for structural integrity of the aluminum for 10-years from the date of delivery, by the Company, to the original purchaser of the property where the floating docks or gangways are installed as set forth in the order form.
B. The Company further expressly warrants that floats purchased from Golden Marine Systems, LLC are warranted through Premiere Materials for 10-years with an additional 5 –year prorated warranty.
2. THIS WARRANTY DOES NOT COVER THE FOLLOWING:
A. All repairs after the applicable warranty period are the Owner’s responsibility.
B. Damage incurred that is not the fault of the Company, such as, damage caused by accidents, misuse, overloading, negligence, alteration, modification, Acts of God, conditions that exceed the design criteria, or abusive operation is not covered by this limited warranty.
C. Damage which is caused by improper product selection, improper installation, failure to follow applicable installation and maintenance recommendations, or failure to follow applicable instructions or warnings are not covered by this limited warranty.
D. All routine maintenance and periodic service is the Owner’s responsibility and is not covered by this limited warranty.
3. WARRANTY DISCLAIMERS:
A. Any applicable implied warranty, including any applicable warranty of merchantability or fitness for a particular purpose, is limited in duration to 10-years from the date of delivery from the company.
B. The company makes no expressed warranties regarding its products except as stated herein. No agent, employee, or representative of the company has authority to bind the company to an affirmation, representation, or warranty concerning the company’s products except as stated herein.
C. Some states do not allow limitations on the length of an implied warranty, so the above limitations may not apply to the buyer.
4. WARRANTY LIMITATION:
A. The Owner’s remedies under this limited warranty are limited exclusively to repair or replacement of components, which fail due to the Company’s defects in materials or workmanship during normal operations.
B. The Company shall not be responsible for incidental or consequential damages, included, but not limited to, damages to property, loss of use, lost profits or expenses of inconvenience.
C. Some states do not allow the exclusion or limitations of incidental or consequential damages, so the limitations or exclusions may not apply to the buyer.
5. THE COMPANY’S RESPONSIBILITY:
A. The Company agrees to provide all necessary parts and materials to correct any warranted defect provided written notice is received by the Company within the applicable ten (10) business day period following incident or recognition of the problem.
6. THE OWNER’S RESPONSIBILITIES:
A. It is the responsibility of the owner to ensure that each product is fit for its intended proposes and that the conditions in which the product will be used for are suitable for this particular product.
B. Aluminum floating docks to be anchored by internal or external pile guides, whether bolted or welded to the frame, must move freely during the entire cycle of water level changes and during times of extreme surge levels. All fasteners should be checked for tightness and regularly retightened especially before and after storm events.
C. The product may require periodic maintenance, which is not covered by the warranty. While the Company may be equipped to handle your service needs, periodic maintenance may be performed by anyone else qualified to do so. The warranty does not cover damage or alterations made by others qualified or not.
D. A reasonable time for repairs must be allowed.
7. WARRANTY CLAIM PROCEDURE:
A. Should the Owner encounter a problem, which might be covered by this limited warranty, the Owner must contact the company in writing within ten (10) business days of the incident or recognition of the problem. The Company’s address for receipt of the notice is as follows: Golden Marine Systems, LLC., 17611 East Street, North Fort Myers, FL 33917.
B. The owner shall provide the following information in its written notice:
1. The type of product purchased and purchase date
2. Serial and/or model number
3. Incident or event date
4. Dealer rep/name
5. Marine Contractor’s information
6. The nature of the problem and/or questions
7. Photos and any other pertinent comments
C. This warranty gives the buyer the specific rights and you may also have other rights, which vary from state to state.
